In this article mortgage relations and their participants are analyzed. Specifically: mortgagor, mortgagee, property guarantor, warrantor, persons who obtain any rights, powers or obligations under the mortgage contract; person of debtor under the credit agreement in whose interests the mortgage contract is made when the mortgagor and property guarantor are one and the same person; as well as creditor, debtor, principal, beneficiary, cedent and cessionary.

The legal nature of participation of the guarantor in the mortgage is defined. The necessity of separation the property guarantee from the contract of guarantee is argued.
